Please read these Terms & Conditions carefully before booking any travel services with NavigoNex. They explain your rights, responsibilities, and the conditions governing our services.
Terms & Conditions
Welcome to NavigoNex. These Terms & Conditions govern your use of our website and the booking of travel services through NavigoNex. By accessing our website or making a booking, you acknowledge that you have read, understood, and agreed to be bound by these terms.
NavigoNex acts as a travel organizer and intermediary, coordinating services provided by airlines, hotels, transport companies, activity operators, destination management companies, and other third-party suppliers.
Definitions
For clarity throughout these Terms & Conditions, the following definitions apply:
1. Acceptance of Terms
By making a booking, submitting an inquiry, or using any service provided by NavigoNex, the Customer confirms that:
- They have read, understood, and accepted these Terms & Conditions in full.
- They are at least 18 years of age or have obtained consent from a parent or legal guardian.
- All information provided by them is accurate, complete, and truthful.
- They have the authority to accept these terms on behalf of all travellers included in the Booking.
- They will inform all travellers in their group of these Terms & Conditions.
2. Booking Confirmation
A Booking is considered confirmed only after all of the following conditions are met:
- All required documents and traveller information have been received by the Company.
- Applicable payments have been successfully completed and funds have been cleared.
- Written confirmation has been issued by the Company via email or WhatsApp.
Availability of hotels, flights, transport, activities, and other travel Services remains subject to confirmation by the respective Suppliers. The Company reserves the right to decline any Booking at its sole discretion.
3. Pricing & Payments
- All prices are quoted in Indian Rupees (INR) unless otherwise stated.
- Prices may change due to airline fares, taxes, currency fluctuations, fuel surcharges, or Supplier pricing changes until the Booking is confirmed and full payment is received.
- Full payment or a specified advance amount may be required before travel depending on the selected package, destination, and Supplier requirements.
- Payment schedules, including advance deposits and balance due dates, will be communicated at the time of Booking.
- Failure to make payments by the specified due dates may result in cancellation of the Booking with applicable cancellation charges.
- All bank charges, transaction fees, and currency conversion costs are the responsibility of the Customer.
4. Cancellations & Refunds
Cancellations and refunds are governed by the Company's Cancellation Policy and the terms of airlines, hotels, transport providers, local operators, and other Suppliers.
- Cancellation charges depend on Supplier policies, booking conditions, and the timing of cancellation.
- Certain Bookings — including non-refundable hotel reservations, promotional flight tickets, peak-season bookings, and activity reservations — may not be eligible for refunds.
- Visa fees, travel insurance premiums, government taxes, service charges, and processing fees are strictly non-refundable.
- All cancellation requests must be submitted in writing to contact@navigonex.com.
The Customer is encouraged to review the Cancellation Policy before making a Booking.
5. Customer Responsibilities
The Customer is responsible for:
- Providing accurate personal information including full names (as they appear on passports), dates of birth, contact details, and any special requirements at the time of Booking.
- Carrying valid passports with sufficient validity as required by destination countries.
- Obtaining all necessary visas, permits, and travel authorizations before departure.
- Complying with immigration regulations, customs requirements, and local laws of all destinations visited.
- Following airline baggage allowances, check-in procedures, and boarding requirements.
- Arriving on time for flights, transfers, tours, and all scheduled activities.
- Possessing adequate travel insurance covering medical expenses, trip cancellation, baggage loss, and emergency evacuation.
- Respecting local customs, traditions, and environmental regulations at all destinations.
The Company shall not be responsible for any consequences arising from the Customer's failure to fulfil these responsibilities, including denied boarding, entry refusal, or additional costs incurred.
6. Passport, Visa & Travel Documents
The Customer is solely responsible for obtaining and maintaining valid passports, visas, permits, vaccinations, and any other required travel documentation. While the Company may assist with visa guidance and documentation support, the Company does not guarantee visa approval.
Visa application fees, embassy charges, courier fees, and processing costs are non-refundable regardless of the outcome of the visa application. The Company shall not be liable for any losses, delays, or expenses arising from visa rejection, processing delays, or incomplete documentation.
7. Changes by the Company
The Company strives to deliver all Services as described in confirmed itineraries. However, in exceptional situations, itineraries, hotels, transport arrangements, sightseeing activities, or schedules may need to be modified due to:
- Operational requirements or logistical constraints
- Supplier changes, cancellations, or service disruptions
- Weather conditions, road closures, or natural events
- Circumstances beyond the reasonable control of the Company
In such cases, the Company will make reasonable efforts to arrange suitable alternatives of comparable standard. If a significant change is required before departure, the Customer will be notified promptly and offered the option to accept the change, choose an alternative arrangement, or cancel with applicable refund terms as per the Cancellation Policy.
8. Force Majeure
The Company shall not be liable for any failure or delay in performing its obligations where such failure or delay results from events beyond its reasonable control. Such events include, but are not limited to:
- Natural disasters, earthquakes, floods, landslides, adverse weather conditions
- Pandemics, epidemics, public health emergencies, disease outbreaks
- Government actions, travel bans, border closures, curfews, quarantine requirements
- Political unrest, civil commotion, riots, acts of terrorism, war
- Airline disruptions, airport closures, airspace restrictions
- Industrial action, strikes, labour disputes
- Fire, explosions, utility failures, telecommunications disruptions
In force majeure situations, the Company will make reasonable efforts to assist affected Customers and seek recoverable amounts from Suppliers. However, the Company cannot guarantee refunds or compensation in such circumstances.
9. Third-Party Suppliers
The Company coordinates travel Services provided by independent third-party Suppliers. These Services remain subject to the respective Supplier's terms, conditions, and limitations.
While the Company exercises reasonable care in selecting Suppliers, it does not control their operations. The Company shall not be liable for:
- Actions, omissions, errors, or negligence of third-party Suppliers
- Service quality, safety standards, or operational decisions of Suppliers
- Supplier bankruptcies, business closures, or service withdrawals
- Accidents, injuries, losses, or damages arising from Supplier services
Any claims or disputes concerning Supplier services should be directed to the respective Supplier. The Company will provide reasonable assistance in communicating with Suppliers where possible.
10. Limitation of Liability
To the extent permitted by applicable law, the Company's liability shall be limited as follows:
- The Company's total liability for any claim arising from a Booking shall not exceed the total amount paid by the Customer for that specific Booking.
- The Company shall not be liable for indirect, incidental, or consequential losses or damages.
- The Company shall not be liable for losses arising from circumstances beyond its reasonable control.
- The Company shall not be liable for loss of enjoyment, opportunity, or anticipated savings.
- Nothing in these terms excludes or limits liability for death or personal injury caused by the Company's proven negligence, or for fraud or fraudulent misrepresentation.
Recommendation: The Company strongly recommends that all Customers purchase comprehensive travel insurance covering trip cancellation, medical expenses, emergency evacuation, baggage loss, and personal liability before commencing travel.
11. Intellectual Property
All content on the Website including text, graphics, logos, images, itineraries, photographs, videos, icons, software, and design elements is the intellectual property of the Company or its content Suppliers and is protected by applicable copyright, trademark, and intellectual property laws.
The Customer may not reproduce, distribute, modify, display, perform, publish, license, create derivative works from, transfer, or sell any content obtained from the Website without prior written consent from the Company. Unauthorized use may result in legal action.
12. Privacy & Data Protection
The collection, use, storage, and processing of the Customer's personal information are governed by the Company's Privacy Policy. By using the Services, the Customer consents to the collection and use of their information as described in the Privacy Policy.
13. Governing Law & Jurisdiction
These Terms & Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the competent courts in Dharamshala, District Kangra, Himachal Pradesh, India.
14. Amendments to Terms
The Company reserves the right to modify these Terms & Conditions at any time. Changes will be effective immediately upon posting on the Website. Continued use of the Services after any modifications constitutes acceptance of the updated terms. The Company encourages Customers to review these terms periodically. The "Last Updated" date at the top of this page indicates when these terms were last revised.
15. Severability
If any provision of these Terms & Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be deemed modified to the minimum extent necessary to make it enforceable. If modification is not possible, the provision shall be severed. The remaining provisions shall continue in full force and effect.
16. Entire Agreement
These Terms & Conditions, together with the Privacy Policy, Cancellation Policy, and any written confirmation issued by the Company for a specific Booking, constitute the entire agreement between the Company and the Customer regarding the subject matter herein. They supersede all prior agreements, understandings, and representations, whether oral or written.
